USCIS District 23 Liaison
Dear Members:
At the USCIS DD meeting yesterday, Jane Arrellano announced that District 23 will no longer accept
I-130 filings benefitting non-detained respondents in removal proceedings. Detained aliens can still
file locally, but can only do so with a with a referral slip from the IJ. This policy change is to
conform to how all other districts, nationwide, process I-130s for beneficiaries in proceedings.
Effective immediately, ALL I-130 petitions for non-detained aliens must be filed with Chicago. The
attached file indicates where to
file such petitions, depending upon the residence of the petitioner.
Helpful tips:
- Please remember to check the box on the I-130 (Page 1, Part C, Question 16 on the most recent form version) that the alien is in removal proceedings and indicate that proceedings are pending.
- Include a highlighted statement in your cover letter indicating that the beneficiary is in proceedings.
- Include a copy of the NTA/OSC and next hearing notice.
- Include a bona fide marriage exemption, if necessary.
After receipt by Chicago, the I-130 will be routed to the appropriate local office for interview
(if necessary).
Please note that John Salter, ICE Chief Counsel, has been advised of the new policy.
